The Louboutin case is back in court today, after last week’s ruling that YSL are in fact allowed to sell their red-soled shoes. YSL’s next step will likely be to try and cancel Louboutin’s trademark. You can read a bit more about the details here on The Cut, but basically, Louboutin’s lawyers are trying to protect their trademark.
Who knew the bottom of a shoe could be so important?
According to an interview on WWD, “Louboutin stands to lose so much. This is identity theft for him. Those red soles are almost as recognizable as his name.”
I am sorry, but am I the only one that thinks this whole scenario is a bit weird? Yes, I feel sorry for Louboutin because if the trademark gets cancelled every single crappy fast fashion store will be selling red soled shoes. But to imply that he will “lose so much” is a bit weird. Why do people buy Louboutins? Hopefully it is not JUST for the red sole. I presumed that people buy Louboutins because they actually LIKE his shoe designs. Shouldn’t the designs have more merit than the colour of the sole? I know that when I almost bought a pair of Louboutins, it was for the design, not the sole. But I can also say that the reason why I decided NOT to go ahead and buy those Louboutins was because they were ridiculously overpriced, and Kim Kardashian had the same pair. I’d be far more concerned about the Kardashians owning entire collections of Louboutin. Perhaps they need to re-concentrate their efforts, pull an “Abercrombie,” and offer to pay the Kardashians to stop wearing their shoes.
I look forward to hearing what happens. If Louboutin hadn’t been such a diva and pursued this case in the first place, he would not be in this position now. |

This year like no other to be holding Louis Vuitton, Chanel or Prada will almost be obscene due to the economic climate. We will be seeing vintage pieces and many more reasonably priced pieces coming forward. In this day and age with the economic strains unknown with Obama predicting an "Apocolyptic Economic Crisis", the fashion savvy will be looking to make the best of their wardrobe even revamping staple Olga Berg Clutches as a $$$ saving suitor. Yves Saint Laurent's shoes: they had a sole that matched the shoe colour.
Christian Louboutin filed a lawsuit against Yves Saint Laurent last month, claiming that YSL violated Louboutin’s red sole trademark. I totally disagreed with this lawsuit, as the collection featured several shoes, all which were in bold colours and had matching soles. While I can understand that Louboutin wants to protect his red sole, I thought his lawsuit was a load of crap. YSL’s collection feature shoes in several colours, a purple shoe with a purple sole, a green shoe with a green sole, and the aforementioned red shoe with the red sole. Don’t get your knickers in a twist Christian, just get over it.
Anyway, I was very pleased to hear that YSL is now suing Louboutin by saying that they have fraudulently obtained the sole “use” of the red sole (pardon the pun…) and they have no right to claim exclusivity of a red sole. The court papers go on to explain the following:
“Red outsoles are a commonly used ornamental design feature in footwear, dating as far back as the red shoes worn by King Louis XIV in the 1600s and the ruby red shoes that carried Dorothy home in The Wizard of Oz. As an industry leader who has devoted his entire professional life to women’s footwear, Mr Louboutin either knew or should have known about some or all of the dozens of footwear models that rendered his sworn statement false.” (Vogue)

I have to say that YSL have a point here (and I like the snarky remark about Louboutin’s lack of expert knowledge.) While Louboutin should be allowed to protect himself from counterfeits, this YSL situation is clearly not that. I also feel that there should be more than just one “signature” to a brand, I mean, can’t Louboutin depend on his high quality, his designs, and his (tacky) celebrity following to uphold his brand status, rather than simply his red sole? I think he is being a total diva here, and I hope YSL wins this one. Then we can all run out and start footwear collections with red soles. What do you think? |
